Section 1813 Native American Energy Rights-of-Way

On February 5, INGAA submitted comments to the Bureau of Indian Affairs, urging that a draft report to Congress by DOE and DOI continues to misinterpret the nature of tribal sovereignty and tribal authority under EPAct, underestimates the problems associated with negotiating renewal and new energy rights-of way across tribal lands, and continues to misrepresent and discount INGAA’s data.  INGAA reinforced those views through a redline version of the draft DOE/DOI report that INGAA filed jointly with the Fair Access to Energy Coalition and EEI on Feb 9.


INGAA is meeting with the Council of Energy Resource Tribes (“CERT”) and the American Tribes of Northwest Indians (“ATNI”) in Denver this week to discuss possible solutions on how to resolve an impasse on right-of-way negotiations.
